General Terms and Conditions (GTC)

§ 1 Subject matter and application of the GTC

These General Terms and Conditions (hereinafter referred to as GTC) govern the relationship between MANOVIS GmbH (as operator of creggles.com) and the customer. These GTC are an integral part of every contract between MANOVIS GmbH and the customer.

§ 2 Conclusion of contract

The presentation of the products (creggles.com) does not constitute a legally binding offer, but an invitation to the customer to place a binding order (offer to conclude a contract).

By clicking on the order button, the customer places a binding order for the products listed on the order page.

Immediately after receipt of the order, the seller confirms receipt of the order by e-mail. The purchase contract is only concluded when the seller confirms the dispatch of the goods by e-mail (order or dispatch confirmation) or at the latest by delivery of the goods.

If payment is made in advance, the purchase contract is concluded when the seller confirms receipt of the advance payment.

§ 3 Prices

All CHF prices quoted in the store include 8.1% VAT. The prices in our offers and order confirmations are generally binding. However, significant errors are reserved.

Prices in other currencies, if available, may be listed without taxes shown.

§ 4 Place of delivery and further use of the delivered goods

We deliver to all countries listed in our terms of delivery.

§ 5 Payment

(see also terms of delivery)

When paying by credit/debit card, PostFinance, TWINT, PayPal or other instant payment methods, the amount is debited when the order is placed.

Default of payment

If the customer fails to meet their payment obligations in full or in part, MANOVIS GmbH may suspend further deliveries of products to the customer.

MANOVIS GmbH may charge an administrative fee of CHF 20.00 for the second reminder. In the event of unsuccessful reminders, the invoice amounts may be assigned to a company entrusted with debt collection. The company entrusted with the collection will claim the outstanding amounts in its own name and for its own account and may charge additional processing fees.

§ 6 Expiry of the order

If payment has not been received ten days after the invoice has been issued, the order will expire and the quantities ordered can no longer be guaranteed in the event of a new order or late payment.

§ 7 Liability

MANOVIS GmbH accepts no liability for damage or injury caused by improper or careless handling of the products.

§ 8 Delivery

Upon receipt of the order (or receipt of payment in the case of prepayment), the order will be processed and dispatched within 2-3 days. Under no circumstances do delays in delivery justify claims for damages or a right to withdraw from the contract.

§ 9 Minimum order value

The minimum order value is CHF 20.00 (incl. VAT, plus shipping costs).

§ 10 Delays in delivery

Delays in delivery that occur during transportation by post from us to you are beyond our control and we accept no liability for them.

Store articles

All items that you have ordered in the online store are in stock and can therefore be dispatched without delay. If an item is temporarily out of stock, you will not be able to add it to your shopping cart in the store.

Delays can therefore only occur with ordered store items if you pay in advance and we have to wait for receipt of payment. Depending on the payment method selected, it may take several days for your payment to reach our account. However, the ordered items will remain reserved for you during this waiting period and will be dispatched within the normal period after receipt of payment. You can shorten the waiting time by sending us a proof of payment (by e-mail) or by choosing a faster payment method such as “card payment”.

Custom-made products

With our quotation, we will give you an approximate production time that we need to manufacture your custom-made product. As a rule, we will dispatch the product within this period.

Large quantities

In the case of an offer for large quantities, we will give you the approximate delivery time that you can expect if you order immediately. However, the quantities offered are not yet reserved for you when an offer is made and it cannot be guaranteed that the delivery date stated will still apply at the time the offer is accepted. Only after acceptance of the offer will you receive an order confirmation with an estimated delivery date. Claims for damages due to late delivery are expressly excluded.

§ 11 Right of return

Customers in Switzerland or Liechtenstein can return the ordered items up to 14 days after receipt of the goods. Custom-made products are excluded from the right of return.

Please contact us by telephone or e-mail before returning an item. In this way, we can process the return more quickly and clear up any misunderstandings in good time.

Use our original packaging for the return or packaging of at least the same size and robustness as the original packaging. Place the goods in the center of the packaging and, if appropriate, use sufficient filling material.

Return address Switzerland:

MANOVIS GmbH
Hauptstrasse 29
4444 Rümlingen
Schweiz

After receiving the goods, we will refund the invoice amount. You must bear the costs of the return shipment yourself. Please stamp the shipment sufficiently.

§ 12 Warranty

MANOVIS GmbH guarantees the functionality of the products supplied. Damage occurring during use is expressly not grounds for a notice of defects or a warranty replacement.

§ 13 Exclusion of warranty

As far as legally possible, with the exception of the guarantee given in § 12, any further warranty of quality and title is expressly excluded.

§ 14 Data protection

Customer data will only be used within MANOVIS GmbH and will not be passed on to third parties.

§ 15 Place of jurisdiction

All obligations are subject to Swiss law. The place of performance and exclusive place of jurisdiction is Lausen.
